Introduction

The Start-Up Visa program is a good option if you have entrepreneurship and business experience, and want to become a permanent resident in Canada. Known as SUV, this program targets individuals with the necessary knowledge and abilities knowledge to start a business in Canada (with the exception of Quebec). Because it is not limited to just individuals, one advantage of this program is you can apply for a start-up visa as a member of a group of up to five people. Another advantage is that it will eventually bring you permanent residence (PR). As a result, obtaining this visa requires several steps, which we will discuss here. Note that as with other types of visas, you must meet the general requirements before you start your application:
  1. You must have a valid travel document, such as a passport;
  2. You must be physically healthy; and
  3. You must not have a criminal or immigration conviction.
After confirming these prerequesites, we will check the following specific conditions for obtaining the SUV.

Specific Conditions for Obtaining a Start-Up Visa

Application Registration

Start-Up Visa_Application RegistrationPerhaps the most important step is having an idea, not just any idea. According to the criteria of Immigration, Refugees and Citizenship Canada (IRCC), the necessary features for these start-up businesses are as follows:
1) Being innovative;
2) The possibility of job creation for Canadians;
3) The possibility of competition on a global scale; and
4) To play a role in improving the Canadian economy.

Application For a Work Permit (Optional)

Start-Up Visa_Application For a Work Permit (Optional)This work permit is only for the start-up visa program. It is valid for one year and is useful if you plan to live in a province other than Quebec. It only allows you to do what is necessary to develop your business as an entrepreneur, and allows you to enter Canada while the IRCC is reviewing your start-up visa application, while you prepare to start your business, and when beginning it.

Company registration

Start-Up Visa_Company registrationAfter getting a letter of support from the designated organizations, you should start your business in Canada. Note: although you must register your business as a company, its success is not a condition. The IRCC does not expect all businesses to succeed, and this program is designed to share risk between the public and private sectors. Bankruptcy or failure of your business does not affect your permanent residence status.

Financial Ability

Start-Up Visa_Financial AbilityRemember that the Canadian government does not provide financial support to those who immigrate with a start-up visa. When applying, we must prove that you have the ability to financially support yourself and your family members (spouse or common-law partner and children under the age of 22) after entering the country. The amount you need is updated every year and depends on the number of family members. Your spouse, common-law partner, and children must also meet the requirements of temporary residence.

English or French language Score

Start-Up Visa_English or French language ScoreYou will also need a language score. Register for one of the tests identified in the Canadian Language Benchmarks (CLB), for example the English International English Language Testing System (IELTS) test which must be general (not academic).

Any valid test score you have taken, whether in English or French, should not be lower than the standard 5 in all skills, i.e., listening, reading, writing, and speaking. However, a score of 4 is sufficient for reading skills.

Eligible Business

Start-Up Visa_Eligible BusinessNow, let's assume that you have a good idea to start a business. We then need to see if your business is eligible. Are you applying alone? If you are making a group request, does each of the members have 10% or more of the voting rights? If this percentage is less, it must be increased to 10% or more. Another important point is that the applicants and the organizations specified to the Immigration Department together must have more than 50% of your company’s voting rights.

Obtaining a Letter of Support

Start-Up Visa_Obtaining a Letter of SupportSuppose you have a good and innovative idea in your pocket. The next step is to obtain a letter of support. What you need to do is introduce your start-up business to one of the organizations listed on the IRCC website and get a letter of support from them. Your business should be in the area of interest of that investment organization.

Common questions

What is the difference between support from venture capital funds and angel investor groups and business incubators?

Venture capital funds focus on companies that have high long-term growth potential, and need capital for their growth and development. The minimum investment amount provided is $200,000.

Angel Investor Groups are organizations or networks of investors who provide capital to new businesses or start-ups in exchange for the ownership of shares. The minimum investment amount for these organizations is $75,000.

Business incubators provide a wide range of resources, services, and support but no funding.

How much money do I need to cover living expenses when obtaining a visa through the start-up program?

The amount of money you need depends on how many family members are coming with you. In some cases, specified organizations give you extra funds to cover living expenses. You cannot use the money you receive for your start-up to cover living expenses.

How do I qualify for the start-up visa program?

You must meet four conditions:

  • Having a qualified business
  • Having a letter of support from designated organizations
  • Meet language requirements
  • Have enough money to cover living expenses before starting a business in Canada.
What happens if I get a letter of support from more than one of the designated organizations?
Receiving support from several venture capital funds or sponsoring investment groups is known as syndication. If you have the support of a syndicate, then all the investor organizations in this company must be introduced. A letter of commitment will be sent to the IRCC, and a letter of support will be given to you.
